Non-Commercial Use: SetWise is a free, personal project provided "as is" for educational and hobby purposes. It is not a commercial product and does not generate revenue.

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the SetWise application (the "Service") operated by SetWise ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Medical Disclaimer & Assumption of Risk

SetWise is NOT a medical organization. The Service creates workout logs and templates for informational purposes only. Nothing contained in this Service should be construed as medical advice or diagnosis.

Consult a Physician: You should consult with your physician or other health care professional before starting this or any other fitness program to determine if it is right for your needs.
Own Will: You expressly acknowledge that your use of the Service is at your sole risk. You are using this application and performing exercises at your own free will.
Risk of Injury: You understand that physical exercise involves strenuous physical movement and carries the risk of injury, disability, or death. You voluntarily accept and assume full responsibility for these risks.

2. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SETWISE, ITS OWNERS, DEVELOPERS, AFFILIATES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, PHYSICAL INJURY, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of or inability to access or use the Service;
Any conduct or content of any third party on the Service;
Any content obtained from the Service;
Unauthorized access, use, or alteration of your transmissions or content.

3. Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

4. User Generated Content

Our Service allows you to create workout templates and logs ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

5. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

6. "AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

7. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect.
